Two senior managers at an Amherstburg car dealership on trial for unfair business practices received some vindication on Friday.
Clarke Chevrolet Buick GMC was found guilty of using an unregistered salesperson and fined $12,500, but two other charges were dismissed against senior managers Jim Clarke and Jesse Howell.
A buyer accused the dealership of providing a contract too confusing to understand. The charges were brought forth by the Ontario Motor Vehicle Industry Council.
"Our investigators and prosecutors in good faith believe the allegations and charges were provable. Unfortunately, the court today disagreed with us," says Terry O'Keefe, OMVIC manager of communications.
Defence lawyer Greg Goulin is calling the court’s decision a win.
"From that moment of, I believe it was May 4th of last year, business just dropped off. So what we have today is pure victory," says Goulin.
Clarke Chevrolet Buick GMC sold the dealership to the Rafih Auto Group on April 30.
OMVIC can appeal to the Ontario Court of Justice in the next 30 days.
"Our prosecutor, our legal staff and the registrar will review the decision,” says O'Keefe.
