The disciplinary hearing of a Windsor police officer continued Tuesday.

Submissions were heard in the Dorothy Nesbeth police act hearing. The Windsor police constable is charged with deceit and discreditable conduct.

Officers with Canada border services agency allege they discovered more than 100 cans of beer, wine and two bottles of rum all undeclared at the Ambassador Bridge back in July 2010.

Council is asking Nesbeth will be cross-examined again, after customs officers had to re-testify due to lost transcripts.

Defence lawyer Patrick Ducharme has called the motion unprecedented calling it 'grossly unfair'.

The decision for cross-examination will be handed down in March.

Nesbeth has been suspended from Windsor police service with pay for three year.
