Lawyers for Ben Johnson are back in court, hoping to appeal the former Windsor Spitfires sexual assault conviction.
Johnson is being represented by prominent Toronto lawyer James Lockyer.
Lockyer has filed an appeal of Johnson’s conviction for the sexual assault of a 16-year-old girl at the former Mynt Nightclub in Windsor in March 2013.
Johnson was sentenced in October 2016 to three years in prison.
Among his arguments for appeal, Lockyer argues the judge in Johnson’s case in Windsor, Justice Kirk Munroe, made a mistake when he chose to dismiss all of Johnson's evidence at trial.
Johnson has been out on bail since November and has been living in Ontario as he awaits word on his appeal.
His matter will be back in the Court of Appeal in Toronto on November 15, but the court still must decide whether or not to grant an appeal of the conviction.
