An appeal hearing halting the Windsor and Tecumseh opt-out campaign in the bingo class action is scheduled to be heard Feb. 25 in Toronto.
The Ontario Court of Appeal agreed to schedule the appeals of the recent decision by the Superior Court of Justice to restrict Windsor and Tecumseh’s communications concerning the opt-out period currently underway.
The plaintiffs in the case have also indicated their intention to appeal the Superior Court decision on an expedited basis.
The appeals on Feb. 25 will go before the Ontario Court of Appeal at Osgoode Hall.
The court order that is being appealed does not permit public comment by Windsor or Tecumseh about the opt-out campaign, other than existing communications remaining in place.
Officials say the city and town will continue to abide by the court’s order unless it is varied or set aside as a result of the appeal.
