A Windsor Superior Court Judge is expected to render a decision on September 1st in the Ben Johnson sexual assault case .
Johnson, a former Windsor Spitfire, is charged with one court of sexual assault for an alleged incident on St. Patrick's day in 2013.
Johnson, now 22 years old, has maintained that he never had sexual intercourse with a girl, who was 16 at the time.
However, Johnson says the girl gave him oral sex in a bathroom stall at the former Mynt nightclub.
The complainant has testified to a different version of the story, saying Johnson forced to have sex.
She has also filed a $3.95-million lawsuit against the hockey player, and the owners of the old nightclub.
