The second degree murder conviction of a Windsor man has been overturned.
The Ontario Court of Appeal For Ontario released the decision on Monday.
Donald Dodd launched an appeal after he was one of two men convicted of killing Peter Kambas and Vaios Koukousoulas in a garage on Moy Avenue on June 29, 2008.
The Court of Appeal concluded “The evidence relied upon by the Crown to prove the appellant’s presence at the scene of the homicides, when viewed collectively, cannot reasonably support a finding that the appellant was in Carter’s backyard at the necessary times.”
The Court ruled “the verdict of guilt against the appellant is unreasonable.”
In February of 2012, Dodd and Timothy Carter and were each found guilty of second degree murder in the 2008 deaths. They were both sentenced to life in prison with no chance of parole for 17 years.
During the trial, the crown alleged Carter and Dodd beat the victims to death in Carter's backyard on Moy Avenue. They say the pair then set the garage on fire to destroy the evidence.
Later that year, the bodies of Kambus and Koukousoulas were found badly decomposed in a Harrow woodlot.
The appeal for Carter was dismissed.
