The group which is trying to prevent a big box store near Ojibway Park says a recent court ruling will make their argument harder when it goes before a municipal board hearing.

A spokesperson for Save Ojibway says the developer, Coco Group, challenged some of issues the group wanted to bring to the hearing.

Nancy Pancheshan says a judge ruled the hearing won't deal with issues concerning the impact the store will have on the water table and issues of lighting.

However the group can present its evidence on the impact of added littering and traffic.

While disappointed, Pancheshan says her group will continue its fight.

No one from Coco returned calls to CTV News.

A hearing date is scheduled for Aug. 24.
