A Windsor developer is filing a $45-million lawsuit against the Ontario government and former MPP Dwight Duncan over issues regarding the former Grace Hospital site.
Lou Vozza is seeking $35 million and another $10 million in punitive damages in a suit filed in Superior Court by Hamilton lawyer George Limberis.
“We’ve sued the provincial government on a number of different claims including misrepresentation and breach of contract,” says Limberis.
The province ended an agreement with Vozza in June 2011 to build long-terms care beds at the site after several delays.
“The issue right now is that Mr. Vozza feels that he was asked to take additional debt,” says Limberis “He advised them that it was not financially viable.”
The former hospital is in the final stages of being demolished for $4-million, to be paid for by the province.
The allegations in the statement of claim have not yet been proven in court.
CTV News attempted to contact Toronto lawyer Ronald Carr, who is dealing with the lawsuit on behalf of the province. He has not yet responded.
