Former Windsor Spitfire Ben Johnson will learn his fate on Tuesday afternoon.
Johnson was found guilty of sexual assault on Sept.1 in relation to a 2013 incident.
The trial lasted 10 days, hearing from 21 total witnesses and 52 exhibits. Ultimately Justice Kirk Munroe determined that Johnson was guilty as the underage victim at the time was too drunk to give consent.
Munroe took more than two hours to read his decision and went through the events from the day of the incident at the former Mynt Nightclub on March 17, 2013.
The court heard victim impact statements and submissions from both the Crown and defence lawyers on Monday.
The Crown is seeking a sentence of three-and-a-half to four years in jail for Johnson, while his defence lawyer Pat Ducharme called that submission "unduly harsh" and asked the judge to consider a very short jail term, at most.
