A Windsor senior, found guilty in a violent home invasion case, is still waiting to hear his fate.

Robert Mahon, 67, had a sentencing hearing on Friday.

He will have to wait until June 6 to learn his punishment for breaking into the home of an elderly couple, tying them up with shoelaces and robbing them at knife point.

If the defence gets its way, Mahon will get four years in penitentiary. The Crown is calling for six to eight years.

When asked by reporters if he would like to comment on Friday’s hearing, Mahon replied “No I don't want to talk to you people."

He says he has nothing to say about it.

He may walk with a cane and is just days from turning 68 years old, but the courts have found Mahon guilty of seven charges related to a violent home invasion.

It happened on McEwan Avenue on July 9, 2011.

Mahon broke through the bedroom window of a home, armed with a knife. He forced the couple to lie on the couch, tied them up with shoelaces and demanded money, drugs, gold and booze. At one point, he cut the female homeowner with the knife.

When he only got away with $165, the victims say he muttered “This is a sorry house to rob."

“He's 68 years old,” says defence lawyer Christina Sweet. “He's not in good health, so whatever sentence, in my opinion, even a three-year sentence, could be a life sentence for him."

Sweet says he's had two heart attacks, he takes no medication and suffers from arthritis.

“He's going to be with a lot of younger men who are in good physical condition, just simply because of their age," she says.

Mahon did not speak when given the opportunity to address the court.

Despite the conviction, he maintains his innocence.

Typically, the low range for a violent crime like this is four to five years. In extreme cases, some offenders have received 11 to 13 years.

Mahon does have a lengthy criminal record, but mostly for property related crimes.
