The Ministry of Labour has issued several orders following two incidents along the Herb Gray Parkway on Tuesday, one of which was a fatality.

Provincial police were called to the parkway at Todd Lane and Huron Church Road at approximately 3:30 p.m. Tuesday in the construction zone.

The Ministry of Labour says it’s reported that a worker was found trapped between two objects. The 40-year-old succumbed to his injuries and was pronounced dead at the scene.

As a result officials have issued the following orders to PCR Contractors Inc.:

  • "An order under requiring the employer to ensure that every part of the project, including temporary structures are adequately braced."
  • "An order requiring workers to be provided with instruction, training and supervision with respect to safe work procedures for the installation and removal of pre-manufactured steel concrete forms.  A related was issued requiring work in this regard to stop until this order is complied with (stop work)."
  • "An order requiring the production of a list of workers, formwork design specifications, drawings, safe work procedures and other technical documents."

The Windsor Essex Mobility Group and Parkway Infrastructure Constructors released a statement late Tuesday evening. In it, project director Michael Hatchell says, “They are saddened to confirm a fatality of an employee of one of the subcontractors.

Hatchell adds, “Our thoughts and prayers are with the families at this time. We are participating fully in ongoing investigations and will provide further information upon its completion.”

At the same time, Windsor police responded to an industrial accident call on the parkway, this one at Huron Church Road and Labelle Street.  According to the ministry, the 28-year-old man was cutting cement when he sustained a leg injury.

The victim was responsive and was transported to hospital.

The MOL has issued an order to PIC requiring them to ensure all employers and workers coply with the OHSA.

Two additional orders were issued to the employer Graff Penhall Company:

  • "Requiring that the employer ensure that all vehicles, machinery, tools and equipment are maintained in a condition that does not endanger a worker."
  • A related order requiring that work with a specified concrete wire cutting saw cease until the above order is complied with (stop work)."

The investigation into both incidents is ongoing.
