The South Sudanese man, who authorities say is 29 but posed as a student at a Windsor high school, will remain in jail.

Jonathan Nicola appeared at his detention hearing on Tuesday wearing an orange jump suit. His lawyer, Frank Miller, was not present.

The Immigration Review Board ruled he’s a flight risk. 

Allegationssurfaced last week that Nicola was posing as a 17-year-old, but isactually 29, according to the Canada Border Service Agency.

Nicola was playing basketball for Catholic Central High School. CBSA alleges that Jonathan Nicola misrepresented material facts on his application ‎for a study permit for Canada.

The CBSA says Nicola submitted an application for a Canadian study permit abroad with a date of birth of Nov. 25, 1998.

When he recently applied for a US visitor visa, the CBSA says they determined by fingerprint match, that he was the same individual who had made a previous application to the United States using a DOB of Nov. 1, 1986.

In an interview with CTV News last December, Nicola said he fled his home in Africa and was living with the team's head coach Pete Cusumano.

Cusumano was at the hearing on Tuesday.

Nicola’s next hearing date is May 24.
