A Lakeshore father is facing criminal charges after two of his children were killed when his van collided with a train last June.

Lakeshore OPP and the Essex County OPP Crime Unit arrested Andrew Williams Tuesday.

“We believe the person was neglect in what he was doing that day,” says Sgt. Rick Tonial. “That neglect caused death or bodily harm to people and that's our concern.”

Williams was charged with two counts of criminal negligence causing death, two counts of criminal negligence causing bodily harm, two counts of dangerous operation causing death, and two counts of dangerous operation causing bodily harm.

Wynter Williams, 6, and her three-year-old sister, Brooklyn, were killed when a CP freight train collided with the family's van outside the town of Lakeshore on June 10.

Their brother Dryden Williams, 4, was sent to a Michigan hospital with serious injuries, but recovered. A fourth child, one-year-old Jasmyn Williams, received minor injuries.

The driver and the children's father, Andrew Williams, was sent to a Windsor hospital with serious, life-threatening injuries.

“It’s very difficult to imagine what good could come from the laying of these charges at all and certainly at this time,” says Greg Monforton , who is representing Angie Williams.

Angie Williams, wife of Andrew Williams, has filed a $9.1-million lawsuit, which names her husband, CP railway, two of its workers and the Town of Lakeshore.

Monforton says despite the charges, the civil suit will continue.

“Even the consideration of the possibility of laying charges is grossly premature," says Monforton.

Monforton is still waiting to hear if the Chief Coroner's Office will conduct an investigation into the circumstances of what happened.

“It's important to remember that what's relative here is the facts and the facts simply have not all been gathered,” says Monforton.

Andrew Williams was released from custody on Wednesday with conditions and will appear in a Windsor court at a later date.
