The family of an 18-year-old girl who died in a car accident after working at the Shores of Erie Wine Festival, has filed a $3.6-million lawsuit against the festival, Sobeys and an organizer.

Emily Bernauer died in a single-car crash on Sept. 6, 2014 while driving on concession two.

Bernauer was found with alcohol in her bloodstream. Her family says someone should have stopped her from drinking and driving.

A statement from Beckett Personal Injury Lawyers, the firm representing the family, said the family believes many adults failed Emily, to an extent that they share responsibility for her death.

“That Emily should not have been behind the wheel that night is apparent, but the question of how she came to be in that situation is precisely what this lawsuit will examine,” said the statement.

It also says the family did not want to take legal action, but are doing so because they believe it will bring to light more information, including undisclosed documents.
