U.S. based Navistar is deciding whether to appeal a provincial tribunal ruling favouring former employees who used to work at the Chatham operation.

The Ontario Financial Services Tribunal dismissed the company's appeal regarding pensions – upholding an original ruling favoring pension rights.

Unifor – the union representing members – says the tribunal has also expanded the terms, loosening retirement requirements to include more workers.

The union also seeking a severance package and is approaching Ontario Labour Relations Board to send the matter to arbitration.

The plant closed in 2011.
