In a case that's been before the courts for the last year, the sexual assault trial for a former Windsor Spitfire is almost over.

Final arguments have been laid out in the case against 21-year-old Ben Johnson, who will learn his fate next month.

The single charge of sexual assault against him stems from an alleged incident at the Krooked Kilt in January of 2013, where it's alleged Johnson forced a woman to touch his penis in the men’s bathroom.

Johnson denies assaulting the woman, but in court testimony admitted to calling her a derogatory name for lesbians, after he walked in on her and another woman in the stall.

Today, defence lawyer Evan Weber said the crown's case was, in his words, inconsistent, implausible and impossible.

He said the victim can't be trusted, as there were a number of inconsistencies in her memory throughout the trial.

He says she couldn't remember whether or not she tried to pull her hand off Johnson's penis and he says she couldn't describe his penis.

Justice Micheline Rawlings said "there's been lots of inconsistencies in this trial" but "the intensity of a situation can affect what details someone can remember or not remember."

She said the human factor must be taken into consideration.

Crown attorney Scott Kerwin suggested Johnson has "selected memory" and that "he remembers things we wouldn't expect him to and forgets things we would expect him to remember."

Kerwin suggested Johnson tailored his evidence to fit his story and said he lied.

Referring to a Facebook apology to the alleged victim's brother Kerwin says Johnson was apologizing for his actions, for exposing his penis in the bathroom stall.

The judge is expected to deliver her verdict Oct. 30.
