A Windsor Justice of the Peace needs two weeks to determine whether she has the authority to withdraw charges against five board members of the Shores of Erie Wine Festival.

The charges were laid against the individuals following a fatal car crash, which took the life of 18-year-old Emily Bernauer on Sept. 6, 2014.

Bernauer was working at the Sobey's booth at the festival.

The Crown wants to withdraw liquor license offenses and instead lay a new charge against the festival corporation.

The lawyer of a sixth board member, Renato Rota, says his charges are still proceeding.
